Regulatory and Operational

We counsel bank clients in such matters as controlling non-loan losses, electronic fund transfers, deposit account structuring, variable rate lending, disclosure requirements, branch acquisition and establishment, municipal securities, ESOP funding, and industrial development bonds.

Transactional

We serve banks in matters of lending (residential and commercial), insolvency (individual and business collections, workouts, bankruptcies, real estate foreclosures and workouts, real property repossessions), and trusts and estates.

Litigation

In addition to collections, bankruptcy, and foreclosures and workouts, which routinely take us to court, we frequently represent banks (and others) in state and federal litigation involving the full spectrum of lender liability issues. We have handled cases of alleged bank employee fraud and defalcation, customer fraud on banks, embezzlements implicating depositor banks, forged instruments, alleged bankers’ negligence and malfeasance, equitable subordination, R.I.C.O., and environmental liability.
